Applying Online Process (5 easy steps to your divorce Order)

If you are ready to apply on-line, please take a minute to read over this information that will help you further understand this process. In 5 easy steps, we will let you know exactly how our office will help you obtain your divorce. Here is how Divorceplease.ca will start your divorce case online:

Step 1. You will fill out some basic information in a questionnaire and submit it on our site. You will also indicate whether you are filing a joint (with your spouse) or simple (alone) divorce.

Simple Divorce- The only request in this type of application should be for divorce. Other claims such as spousal support, custody, .............................etc. are not filed in a simple divorce.

Joint Divorce- The application is submitted by both parties, in another words you are starting a divorce application jointly. You will not ..........................have to serve your spouse with a copy of the divorce application if you are filing jointly.

Step 2. In a matter of a day or two, Divorceplease.ca will send you completed divorce applications for review. If you pre-paid for our service, we will e-mail you the divorce papers, which you will sign and mail back to our office. If you feel more comfortable paying in person, we will make arrangements for you to visit our office location.

Step 3. We file the application with the Ontario Family Court. If you are applying for a sole divorce, your spouse has to be served with a copy of the application after the court processes it. The document can be either served by Mail or In Person.

Step 4. At this point, we will make arrangements for you to swear the required documents for your case. The final documents can be filed with the court after a "clearance certificate" is issued by an agency in Ottawa. This usually take 8 weeks to arrive at the court where you filed your application.

Step 5. After the final documents are filed, you should receive a 'divorce order' in the mail in about 3-4 weeks. Your divorce will take effect after 31 days from the date the judge signed your divorce order.

I understand the process but how long will this all take?

It usually takes about 4 months for the entire process. This is mainly based on how long the "clearance certificate" takes to arrive from Ottawa and also how fast the court processes your files. However, in most cases an uncontested case does not take longer than 4 months to complete.
